General Terms and Conditions (GTC) – Holafinca.de
Dear Guest,
It is important to us that both you and we have clear rules regarding the booking and use of our holiday properties. We have deliberately avoided unnecessary clichés and complicated legal jargon, aiming to make these terms and conditions as clear as possible. Please read these GTC carefully, as they form an integral part of your booking contract.
1. Formation of Contract
By making a booking, a contract is established between you and the owner of the holiday accommodation. Holafinca acts as an intermediary for the accommodation on behalf of the landlord and is authorized to handle the booking process, payments, and communication.
2. Payments (Deposit, Balance)
Deposit: Upon receipt of the booking confirmation, a deposit—ranging from 10% to 30% of the total price, depending on the specific property—is due and payable within 7 days. The specific deposit amount for your chosen property is listed under "Rental Conditions" on the respective property's webpage.
Balance Payment: Due 4 weeks prior to the start of the rental period. Depending on the booking confirmation, this payment is to be made either to Holafinca’s bank account or directly to the landlord.
Transfer Fees, etc.: Payments must be made free of charges (i.e., with all bank fees covered by the sender) to the bank account specified in the booking confirmation.
Cancellation and Rebooking Fees: Due immediately.
On-site utility costs (consumption charges) must be paid to the keyholder on the final day of the rental period.
In the event of non-payment following a payment reminder, Holafinca or the landlord reserves the right to withdraw from the contract and claim cancellation fees.
3. Security Deposit
The amount of the security deposit is specified in the booking confirmation and must be paid in cash upon arrival at the property. In isolated cases, the landlord may request that the security deposit be paid via bank transfer instead. The security deposit will be refunded on the final day of the rental period—or no later than 14 days after your departure—provided that no counter-claims exist. Unpaid utility costs may be deducted from the security deposit.
4. Pets
Pets are permitted only if expressly allowed in the accommodation's property description and listed in the booking confirmation. Any pet must be registered with us either prior to or at the time of booking. Additionally, the Pet Agreement must be signed, and the pet deposit (ranging from €200 to €500) must be paid. The refund process for the pet deposit mirrors that of the standard security deposit: it is refunded on the final day of occupancy—or no later than 14 days after departure—following an inspection for any potential damages.
5. Withdrawal, Rebookings, and Substitute Guests
5.1 Withdrawal by the Customer (Cancellation)
You may withdraw from the rental agreement at any time prior to your arrival. We recommend submitting your notice of withdrawal in writing.
5.1.1. Flexible Cancellation:
a) Up to 30 days prior to the start of the trip: No flat-rate cancellation fees apply; only the initial down payment will be retained. The amount of the down payment is displayed on the respective property page prior to booking.
b) From the 29th day prior to the start of the trip: 90% of the rental price.
5.1.2. Standard Cancellation:

• Up to 90 days prior to the start of the trip: 20% of the rental price
• 89–60 days prior: 30% of the rental price
• 59–30 days prior: 50% of the rental price
• From 29 days prior, or in the event of a no-show: 90% of the rental price
The landlord reserves the right to claim higher cancellation fees if they can demonstrably prove that they have incurred greater financial loss. You, in turn, may provide evidence demonstrating that Holafinca or the landlord incurred no loss, or a loss of a lesser amount.
5.2 Rebooking
There is no entitlement to rebooking. Upon request, changes (date, destination, accommodation) may be made, for which Holafinca charges a rebooking fee of up to €30 per transaction. In this instance, too, you may provide evidence that Holafinca incurred no loss, or only a lesser loss.
5.3 Substitute Guests
You may designate another person as the renter. Holafinca must give its consent, and the designated person must accept the terms and conditions of the contract. All rights and obligations arising from the booking shall be transferred to the substitute guest.
6. Arrival, Keys, and Use of the Accommodation
Check-in/Check-out: Arrival and departure times are specified in the booking confirmation. As a general rule, check-in is available from 4:00 PM, and check-out is required by 10:00 AM.
Keys: Key handover takes place directly on-site, facilitated either by Holafinca staff or by the property owner.
Liability for Lost Keys: In the event of key loss, the owner may charge for the cost of replacement keys or for replacing the lock.
Usage: You undertake to treat the accommodation with care and to report any damages immediately.
Maximum Occupancy: The specified maximum number of guests must not be exceeded.
Parties are generally not permitted. Groups consisting of travelers under the age of 26 are requested to contact us for prior approval.
6.1. Electric Vehicles and Use of Power Connections
Charging electric vehicles (electric cars, e-scooters, e-bikes, or similar) using the property's standard power supply is generally not permitted, unless the specific property description explicitly indicates that a suitable charging facility (e.g., a wallbox) is available or that charging is expressly permitted. The existing electrical systems in the holiday properties are typically not designed to withstand the load associated with charging electric vehicles. Unauthorized use may result in significant damage to the electrical system as well as power outages that could affect the entire property or neighboring units. In the event of a violation of this rule, the owners expressly reserve the right to claim damages. This applies in particular to damage to the electrical system, consequential damages, and costs incurred due to operational downtime.
7. Customer Obligations
Compliance with house rules and local regulations.
Responsibility for personal valuables and pets.
No commercial or illegal activities within the accommodation.
8. Liability
Holafinca shall not be held liable for any damages, losses, or accidents occurring during the stay. The landlord is responsible for any defects within the accommodation. Holafinca shall not be held liable for events of force majeure (e.g., natural disasters, civil unrest, strikes).
9. Data Protection
Your data will be used solely for the purpose of processing your booking and for communication. Data will be shared exclusively with the landlord or service partners (e.g., payment service providers). For further details, please refer to the Privacy Policy on Holafinca.de.
10. Changes to the Terms and Conditions
Holafinca reserves the right to modify these Terms and Conditions at any time. For stays that have already been booked, the terms and conditions valid at the time of booking shall apply.
11. Final Provisions
The place of jurisdiction shall be the registered office of Holafinca, insofar as legally permissible. Should individual provisions prove to be invalid, the remainder of the contract shall remain in force.
